1. Acceptance of Terms
By accessing or using MSHA Intelligence (“the Service”), operated by CementOps AI LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
MSHA Intelligence provides AI-powered analysis of publicly available Mine Safety and Health Administration (MSHA) enforcement data, including citation analysis, industry benchmarks, defense strategies, and compliance insights. The Service is available in free and paid tiers.
3. Not Legal Advice
The Service provides informational analysis only. Nothing provided by the Service constitutes legal advice. You should consult qualified legal counsel for specific compliance questions, citation contests, or regulatory matters. We make no guarantees regarding the accuracy, completeness, or timeliness of any analysis or recommendation.
4. Accounts and Subscriptions
You are responsible for maintaining the security of your account credentials. Paid subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or systematically extract data from the Service beyond normal API usage
- Share account credentials or API keys with unauthorized parties
- Exceed published rate limits or attempt to circumvent access controls
- Misrepresent the Service’s output as certified legal or regulatory advice
6. Data Sources
The Service is built on publicly available MSHA enforcement data obtained from the U.S. Department of Labor’s MSHA Open Government Data initiative. We do not guarantee that our database reflects the most recent MSHA data releases.
7. Intellectual Property
The Service, including its design, code, AI models, and analytical methodologies, is the intellectual property of CementOps AI LLC. MSHA enforcement data itself is public domain. Our analysis, presentation, and AI-generated insights are proprietary.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CEMENTOPS AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSSES FROM RELIANCE ON SERVICE OUTPUT FOR REGULATORY COMPLIANCE DECISIONS.
9. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.
